What is Innocent Spouse Relief and Do I Qualify?

Most married couples file as Married Filing Jointly. There are typically tax advantages to filing jointly versus separately. However, with Married Filing Jointly, one impact is that by default, each spouse is individually liable for the taxes due on a joint return regardless of who earned the income and the IRS can collect from both spouses. What happens if your current or former spouse fails to declare all income or claims improper deductions? Is the “other” spouse responsible for the additional tax burden? Maybe not.
